# NYC’s No. 4 Heating Oil Ban: What July 1, 2027 Means for Your Boiler Chimney

**Short answer: under Local Law 32 of 2023, no boiler in New York City may burn No. 4 heating oil after July 1, 2027.** Buildings still on No. 4 must switch to ultra-low sulfur No. 2 oil, natural gas, dual fuel or another clean option. Most of those projects touch the chimney too, because a new fuel or a new boiler often needs a relined, resized or rebuilt flue.

For owners, co-op and condo boards and property managers, that makes the next two heating seasons the planning window. Here is what the ban requires, why the chimney is part of the conversion, and how to keep the venting side of the project from becoming the delay.

## What the Law Says

The city has been phasing out heavy heating oils since Local Law 43 of 2010. No. 6 oil is already gone. In 2023 the City Council passed, and the mayor signed, a bill that moved the No. 4 deadline up from 2030:

- **City-owned buildings:** No. 4 oil prohibited after July 1, 2025
- **All other buildings:** No. 4 oil prohibited after July 1, 2027
- **Permits:** since June 30, 2024 the city no longer issues or renews permits for boilers burning No. 4 oil

The law includes a hardship process that lets owners apply to the Department of Buildings for a temporary extension, and violations carry fines. For a summary written for building owners, see [Habitat Magazine’s coverage of the ban](https://www.habitatmag.com/Publication-Content/Green-Ideas/2023/2023-March/It-s-Official-Dirty-No.-4-Fuel-Oil-Is-on-the-Way-Out) . The ban also works in the same direction as Local Law 97, since cleaner fuel lowers a building’s emissions.

## Why the Chimney Is Part of the Conversion

Boiler rooms get most of the attention in a fuel switch, but the venting system has to match the new equipment. Three things change:

![Corroded commercial boiler stack being replaced on a building roof](https://thechimneyprofessionals.com/wp-content/uploads/2026/08/rusted-chimney-replacement__hero.webp)

### 1. Exhaust temperature and condensation

Heavy oil boilers run hot exhaust through large masonry stacks. Gas and modern No. 2 oil equipment, especially high-efficiency models, produce cooler exhaust with more water vapor. In an oversized masonry flue that vapor condenses, mixes with combustion byproducts and forms acids that attack mortar, clay liners and steel breeching. The usual fix is a new stainless steel liner sized for the new load.

### 2. Flue size

A stack that was sized for a large No. 4 boiler is often far too big for a new, smaller or modular boiler plant. An oversized flue drafts poorly and condenses more. Load calculations determine the correct diameter and height.

### 3. Breeching and connections

New boilers often sit in different positions, use different outlet sizes and may be vented in combination with water heaters. The breeching usually has to be redesigned, and every connection has to be sealed and supported to code.

## Your Options, From the Chimney’s Point of View

| Conversion path | What usually happens to the chimney |
| --- | --- |
| No. 4 to No. 2 oil, same boiler with burner changes | Inspection and cleaning; liner check for condition; breeching repairs if corroded |
| No. 4 to natural gas or dual fuel, new boiler | New stainless steel liner or stack sized to the new boiler; new breeching; draft testing |
| New high-efficiency condensing boilers | Often a dedicated listed venting system; the old masonry stack may be used only as a chase |
| Partial electrification (heat pumps plus a smaller boiler) | Resizing or relining for the reduced load; orphaned water heaters need their own correctly sized vent |

## A Realistic Timeline

1. **Now to early 2027: survey and design.** Your engineer or mechanical contractor sizes the new plant. Ask for a chimney inspection at the same time so the venting design is based on real conditions, not drawings from decades ago.
2. **Permits and utility work.** Gas service upgrades and DOB filings take time. Chimney drawings and documentation should be ready so they do not hold up the filing.
3. **Installation.** Liners, stacks and breeching are usually installed alongside the boiler work, ideally outside heat season.
4. **Testing and close-out.** Draft testing and documentation for inspectors and insurers.

With the deadline falling at the start of summer 2027, the 2027 off season will be crowded. Buildings that plan their venting in the 2026-27 season will have more contractor availability and fewer surprises.

## How We Help With Conversion Projects

We handle the chimney side of fuel conversions from survey to close-out, and we work as a subcontractor for mechanical contractors and GCs:

- [Commercial chimney inspection](https://thechimneyprofessionals.com/services/commercial-chimney-inspection/) with camera scans and a written condition report
- Load-based sizing of liners, stacks and breeching
- Engineered drawings and permit filing support
- [Commercial chimney installation](https://thechimneyprofessionals.com/services/commercial-installation/) of UL Listed stainless steel systems we manufacture in house, which removes supplier lead times from the schedule
- [Chimney rerouting](https://thechimneyprofessionals.com/services/chimney-rerouting/) when the new boiler room layout changes the flue path

## Frequently Asked Questions

### When does the No. 4 heating oil ban take effect in NYC?

For privately owned buildings, after July 1, 2027. City-owned buildings were required to stop by July 1, 2025.

### Does converting from oil to gas require a new chimney liner?

Often, yes. Gas exhaust is cooler and wetter, so an old oversized masonry flue usually needs a stainless steel liner sized to the new boiler to prevent condensation damage and poor draft.

### Can we keep our existing boiler and switch to No. 2 oil?

Sometimes, with burner modifications. The chimney still should be inspected and cleaned, because No. 4 oil leaves heavy deposits.

### Who files the permits for chimney work in a conversion?

Typically the mechanical contractor or engineer leads the filing, and we provide chimney drawings and documentation to support it.
